By accessing or using VocaCare AI, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not access or use the service.
These Terms apply to users, customers, account holders, elderly users receiving voice-based check-ins, and organizations using the service where applicable.
These Terms should be read together with the Privacy Policy, which forms an important part of the overall service framework.
VocaCare AI is a non-medical wellbeing monitoring service based on short, automated voice interactions with elderly users.
The service does not provide medical diagnosis, medical advice, treatment, or emergency services.
VocaCare AI is intended as a non-medical wellbeing monitoring service and is not presented as a medical device within the meaning of applicable medical device regulation for the initial version of the service.
Account holders must be at least 18 years old. Elderly users must be legally capable of giving consent, or consent must be provided by a legally authorized representative where applicable.
Use of the service requires explicit and informed consent for participation in voice interactions and the associated processing of personal data. Consent may be withdrawn at any time.
Users and account holders agree to use the service responsibly and lawfully.

Account holders remain responsible for interpreting informational outputs in a reasonable and responsible manner.
Personal data is processed in accordance with the GDPR and the VocaCare AI Privacy Policy, which forms an integral part of these Terms.
The service is provided on a best-effort basis. Continuous or uninterrupted availability is not guaranteed.
Planned maintenance, technical issues, telephony dependency, third-party outages, or other unexpected disruptions may affect the availability or performance of the service.
ZorgaNova B.V. is not liable for temporary unavailability of the service to the extent permitted by applicable law.
The service may be offered on a subscription basis, including monthly or annual plans, depending on the applicable offering.
All intellectual property rights relating to the service, including software, models, interfaces, designs, branding, and documentation, remain the exclusive property of ZorgaNova B.V. or its licensors.
Users receive only a limited, non-exclusive, non-transferable, and revocable right to use the service during the applicable subscription term and in accordance with these Terms.
To the maximum extent permitted by Dutch law, ZorgaNova B.V. shall not be liable for indirect, incidental, consequential, or special damages arising out of or related to the use of the service.
ZorgaNova B.V. shall not be liable for decisions made by users or account holders based on service outputs, which are informational in nature.
Where liability cannot lawfully be excluded, total liability shall be limited, to the extent permitted by law, to the fees paid by the user for the service in the preceding twelve months.
Either party may terminate the subscription at the end of the applicable billing period or in the event of a material breach, subject to any mandatory legal requirements or specific contractual arrangements.
Upon termination, access to the service ends and relevant data will be deleted or anonymized in accordance with the Privacy Policy and applicable law.
ZorgaNova B.V. may update these Terms from time to time. Material changes will be communicated in advance where required by applicable law.
These Terms are governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of the Netherlands, unless mandatory law requires otherwise.
